Terms and Conditions of Speech To Text Service
Diamond Voice Speech to Text (STT) services are available to you under the following terms and conditions as revised from time to time by Diamond Voice. The current version of these terms and conditions will always be posted at www.diamondvoice.com. If you should break the rules provided in this agreement, we may have to suspend or terminate your service.
Fees
You can always check www.diamondvoice.com for our latest published prices and the prices that will be applied to your Account. We track the number of transcriptions and reserve the right to charge for undelivered transcriptions, whether by SMS or email, except where the failure to deliver is shown to be our fault. Diamond Voice STT reserves the right to limit the use of the service if we find any unreasonable usage has occurred on the account at any time.
Your Account Registration Responsibility
It is most important that Diamond Voice be able to rely on the information that you provide us about you, and therefore you must confirm that you have provided and will provide accurate, current, and complete information about yourself to us and agree to inform us if that information changes. Should we suspect that you have not done this, we may have to suspend or terminate your account. We will guard your information very carefully and will only use your information in accordance with our Privacy Policy, which can be found by clicking here .
Confidentiality
We will not disclose outwardly any of the information that has been designated to be confidential or that is obviously confidential in nature. By "Outwardly" we mean persons other than employees, representatives, or any third parties who need to receive the information to provide the service.
Personal Information
We guarantee that we will follow all relevant data protection laws and regulations. In particular, we will never make available any personal data without consent unless necessary in providing the service.
Protection
You will indemnify and hold us and our employees, officers, agents, and subsidiaries harmless from any expenses, damages, or losses, including any legal fees or consequential losses due to your use of the service. You may not reproduce, duplicate, copy, sell, resell, or exploit for any commercial purposes, any portion of the Diamond Voice STT service.
Services Modifications
We reserve the right to modify or discontinue, temporarily or permanently, the service, with or without notice and liability to anyone. We reserve the right to terminate your User Login, password, or use of the service, and remove and discard any content within the service.
User Conduct
We at Diamond Voice cannot be held responsible for any of the text, sound, or content of any of your messages. We do not believe in screening content. We do not allow our service to be used to send unsolicited marketing material. Should you send any message deemed to be marketing material or spam through the Diamond Voice STT service, you will be charged $100 for each and every person or number that receives this unauthorized message.
Diamond Voice's Rights
The service and the software required to provide the service are the intellectual property of Diamond Voice STT and is protected by law. In joining our service, you agree that content contained in information presented to you through the Diamond Voice STT service is protected by copyright, trade mark, patents and other proprietary rights and laws. You are prohibited from accessing the service through any other means than through the interface provided to you by Diamond Voice STT.
Notices
Notices of any changes to the Diamond Voice STT service will be sent by email, SMS, or through our website. Feel free to contact us for any reason through any of the numbers provided in our contact information made available on our website.
Service Disclaimer
Some messages cannot be transcribed due to poor dictation, noisy environment, poor phone connection or drop-outs, or language. In this event, you will be notified by email so that you can be alerted of the new voicemail and listen to it in your voicemail box or by the audio file sent to your email. No guarantees are made as to the quality of the transcription provided or that a particular message or messages can or will be transcribed. Due to possible limitations of delivery mechanisms beyond our control, no guarantees are made or implied as to successful delivery.
Limitation of Liability
We do not control the content and are therefore not responsible for any errors or omissions in any of the content we provide even if it is a result of negligence. We are not liable for any indirect loss or for loss of profits, goodwill, time use, data or other intangible losses.
Free Trial Period
The Free Trial Period begins the day after you submit your request to activate STT on your voicemail box service. The free trial is good for 30 days and is limited to 50 messages or 30 minutes of audio recording. By requesting activation under this promotion, you are agreeing to an ongoing subscription to STT service unless you contact Diamond Voice to cancel within 5 days of expiration of the 30 Day Trial. The Free Trial Period may apply to all mailboxes associated with your account or just those that you specify.
